By accessing or using OffboardSafe (“the Service”), operated by Lafoba (“we,” “us,” or “our”), you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you may not access the Service.
These terms apply to all visitors, users, and subscribers of the Service, including administrators, team members, and any other individuals who access the platform.

OffboardSafe offers multiple subscription tiers to meet the needs of different organizations:
All paid subscriptions are billed annually. Your billing cycle begins on the date you subscribe to a paid plan and renews automatically each year unless cancelled before the renewal date.
Subscriptions automatically renew at the end of each billing period. We will attempt to charge your payment method on file at the then-current subscription rate. You will receive a renewal reminder via email at least 14 days before your renewal date.
We reserve the right to adjust subscription pricing. Any price changes will be communicated at least 30 days in advance and will take effect at the start of your next billing cycle. Continued use of the Service after a price change constitutes acceptance of the new pricing.
All payments for OffboardSafe subscriptions are processed through Stripe, a third-party payment processor. By subscribing to a paid plan, you agree to the following:
We accept major credit and debit cards (Visa, Mastercard, American Express, Discover) processed securely through Stripe. All payment information is transmitted directly to Stripe and is never stored on our servers.
Your use of Stripe as a payment method is subject to Stripe’s Terms of Service and Stripe’s Privacy Policy. We encourage you to review these documents, as they govern how Stripe handles your payment data.
Stripe is a certified PCI Level 1 Service Provider, the highest level of certification in the payment card industry. This means your credit card data is handled with the highest security standards. OffboardSafe does not process, store, or transmit cardholder data directly.
If a payment fails, we will notify you via email and attempt to process the payment again. If payment cannot be collected after three attempts over a 10-day period, your subscription may be suspended until the outstanding balance is resolved.
All prices are listed in United States Dollars (USD). If your payment method is denominated in a different currency, your bank or card issuer may apply currency conversion fees.

Our Platform: The OffboardSafe platform, including its software, design, logos, and documentation, is owned by Lafoba and protected by intellectual property laws. You are granted a limited, non-exclusive license to use the Service for the duration of your subscription.

We strive to maintain 99.9% uptime for the OffboardSafe platform. However, we do not guarantee uninterrupted access and are not liable for downtime caused by:
Enterprise plan subscribers may negotiate custom SLA terms with guaranteed uptime and compensation for downtime.
To the maximum extent permitted by law, Lafoba and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or related to your use of the Service.
Our total liability for any claim arising from these terms or your use of the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.
You agree to indemnify, defend, and hold harmless Lafoba and its affiliates from and against any claims, liabilities, damages, losses, and expenses arising out of or related to your use of the Service, your violation of these terms, or your infringement of any third-party rights.
We may update these Terms of Service from time to time. When we make material changes, we will:

These terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes arising from these terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, unless you opt out within 30 days of accepting these terms.
